1. Agreement and operator
These terms cover use of IsMySongAHit.com and the free audio-analysis features. Paid terms apply only to an expressly purchased service after checkout has been enabled. The proposed operating entity is DPA Services, LLC, 6421 N Florida Ave, D-654, Tampa, FL 33604, United States. The operator must confirm its authorization and publish a working customer-support email before commerce starts.
2. Eligibility and audio rights
Use the tools only on audio you own or have permission to analyze or submit. You retain the copyright, publishing, master, and other rights you already hold. You grant the operator only the limited permissions necessary to provide any human review you expressly request; no ownership or general-purpose model-training license transfers through ordinary use.
3. Scope and limitations
Free outputs are approximations and heuristics for audio-production decisions, not certified measurement, copyright advice, investment advice, or predictions of streams, chart positions, playlist placement, revenue or success. Human review is subjective advice, not a guarantee of outcome. The operator does not buy promotion, guarantee editorial placement or control third-party platforms.
4. Pricing and checkout
When commerce is enabled, each service is a one-time purchase unless its hosted checkout expressly and clearly discloses otherwise. Before payment, the checkout must identify the product, included deliverables, total price, currency, tax if applicable, promotional terms, estimated delivery window and any permitted multiple quantities or coupon codes. A promotional comparison price must be a genuine, substantiated reference price. The hosted provider processes payment under its terms. Never submit payment-card information to this website or by email.
5. Fulfillment, corrections and refunds
Work begins only after the operator independently verifies successful payment, confirms the customer's order and provides a private intake process. The applicable written offer and receipt must identify the number of songs, format of feedback, expected turnaround, allowed revisions, and cancellation/refund conditions. If service is not delivered as expressly described, contact support for review of a remedy. Nothing in these terms limits non-waivable statutory refund, consumer or payment dispute rights. Final refund and cancellation rules must be approved and published before the first paid checkout.
6. Confidentiality and user conduct
Do not submit unlawful, infringing, malicious or unauthorized material. The operator may need access to recordings supplied for paid human review and must limit access to people and providers necessary to fulfill the order. Do not publish another artist's private work or share a customer's files outside the approved workflow.
7. Availability and liability
The free tool is provided as available and may experience errors or outages. To the extent permitted by applicable law, the operator excludes implied warranties and liability for indirect or consequential losses associated with reliance on an estimate or general music-review opinion. Nothing excludes liability or customer rights that cannot lawfully be excluded, including liability for fraud, willful misconduct or other non-waivable obligations.
8. Disputes, changes and contact
Contact customer support first with your order number and issue so the operator can review it. These terms do not impose mandatory arbitration or waive class actions. Any applicable law or venue language requires a separate attorney-reviewed decision. Material changes apply prospectively unless law permits otherwise.
